WOXTEL - Data Privacy Policy

The current policy of non-disclosure of the user data (hereinafter “the Policy”) applies to all the user data and other information (hereinafter “the Data”) which WOXTEL mobile applications for iOS/Android and WEB-platforms (hereinafter “Mobile application”), Woxtel services (hereinafter “the Services”), sites •woxtel.com, •wox-tel.web.app, •woxtel.app.link, etc. Including all sub-domains (hereinafter “the Sites”) and all together (hereinafter - WOXTEL), can receive from the User in the process of using WOXTEL, including the Data that the User can independently process and transfer to other WOXTEL Users. The User's consent to the processing of Data given by him in accordance with this Policy within the framework of relations with one of the WOXTEL persons, its affiliates, including those in the same group with WOXTEL, applies to all of his persons at the same time.

WOXTEL does not have the ability to decrypt User Data and cannot judge its legitimacy, as well as whether the User has sufficient legal capacity to process such data. Nevertheless, WOXTEL assumes that WOXTEL Users do not violate the law and take full responsibility for their actions related to the use of WOXTEL, while respecting the personal, political, socio-economic and cultural rights of others and WOXTEL. The use of WOXTEL means the unconditional consent of the User with this Policy and the conditions for processing user data specified therein. In case of disagreement with these conditions, the user must refuse to use WOXTEL.

1. User data

1.1. Within the framework of this Policy, "user data" means:

1.1.1. Any information and photos that the User independently indicates about himself when filling out profile data, in requests of the technical support, etc., including but not limited to the personal data provided by the user independently when using WOXTEL, including special and other information, for example , for the possibility of providing the user with the paid and free services.

1.1.2 Data that are automatically transmitted to WOXTEL in the course of usage or using third-party software and operating system installed on the user's device, including the device's IP address, web beacons (pixel tags), information from cookies, fingerprint, technical information about the user's device (and / or other program with which WOXTEL is accessed), access time, request URL, etc.

1.1.3 Any content that Users exchange with each other while using WOXTEL or using third-party software and operating system installed on the User's device.

1.2. This Policy applies only to WOXTEL and does not apply to, and is not responsible for the services, websites and mobile applications of third parties whereto the User can follow a link accessible from WOXTEL, also in case of searching. Other information can be accumulated in or requested from such sites and applications, including the personal data, and other actions can be made on such sites and applications which WOXTEL does not control and may not be liable for them.

1.3. WOXTEL does not verify the accuracy and legitimacy of the information provided by the users in the process of using WOXTEL, and does not exercise control over their legal capacity. However, WOXTEL assumes that all the Users are competent, do not use WOXTEL for illegal purposes and are personally liable for all their actions related to the misuse of WOXTEL.

2. Processing and storage of the User's data

2.1. The User's Data in WOXTEL is protected by encryption, and User's identifiers are anonymized and used only to provide WOXTEL services to the Users (fulfillment of agreements and obligations of WOXTEL to a specific user).

2.2. An anonymized WOXTEL User IDs can be used for the following purposes:

2.2.1. The User identification under WOXTEL agreements and obligations to him;

2.2.2. Providing the User with the personalized services and assistance;

2.2.3. Communication with the User, including sending notifications, requests and information regarding the use of WOXTEL, the provision of the personalized services, as well as processing the personal requests and requests from the user;

2.2.4. An improvement of WOXTEL quality, WOXTEL usability, a development of new WOXTEL functionality;

3. Conditions for processing the User Data and transferring it to third parties

3.1. WOXTEL stores and processes user information in an encrypted form, but the user can independently transfer any Data through WOXTEL, including personal data, in accordance with the internal regulations of third-party services.

3.2. With regards to the user information transmitted through WOXTEL, its complete confidentiality is maintained, except for the instances when the User voluntary provides information about himself/herself in public use to the unlimited number of persons.

3.3. WOXTEL can transfer the Users’ information to third parties in the following cases:

3.3.1. The User gave his/her consent for such actions and transferred such information to WOXTEL by himself/herself;

3.3.2. The transfer of such data is provided for by an applicable law within the framework of the procedure established by the law and such data are available in WOXTEL (device IP address, information from cookies, fingerprint, technical information about the user's device);

3.3.3. In order to protect the rights and lawful interests of WOXTEL and third parties in the instances when the User provided such information by himself/herself.

3.4. WOXTEL does not control how the Users exchange the data via WOXTEL. The encrypted Data is stored in the cloud infrastructure of WOXTEL during a limited period of time. We do not have deciphered copies of the Data which the Users exchange via WOXTEL and we do not have keys for the deciphering the Users’ content.

4. Who has access to the user information in WOXTEL

4.1. All data in WOXTEL are encrypted in such a way that only the sender and the recipient or recipients can decrypt them if the data are sent to a group of recipients (hereinafter referred to as Addressees). Thus, no one except the Addressees, even WOXTEL, can decrypt data and files saved and / or transmitted via WOXTEL.

5. Measures used to protect information in WOXTEL

5.1. WOXTEL takes the necessary and sufficient organizational and technical measures to protect all the user information from an unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other illegal actions of third parties with it.

6. Changes to the Policy. Applicable legislation

6.1. WOXTEL has the right to make changes to this Policy. When making changes in the current edition, the date of the last update is indicated. The new version of the Policy comes into force from the moment it is posted, unless otherwise provided by the new version of the Policy.

6.2. English law of Great Britain (England and Wales) shall apply to this Policy and the relationship between the user and WOXTEL arising in connection with the application of this Policy, in accordance with which all disputes and disagreements between the parties are resolved.
